Privacy Notice

This privacy notice has been prepared by Alfa Konteyner (“Alfa Konteyner” or the “Company”) under the Turkish Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Procedures and Principles for Fulfilling the Obligation to Inform, in order to inform you about the processing of personal data obtained through our website and communication channels.

2. Personal data we process

When you contact us via the quote form, email, phone or WhatsApp, and when you visit our website, the following personal data may be processed:

• Identity data: First name and surname.
• Contact data: Phone number, email address.
• Professional data: The name of the company or organisation you work for.
• Request and transaction data: The product or solution you are interested in, project location, number of containers or staff, requested delivery date, period of use and any other details you enter in the contact form; quotations and correspondence sent to you.
• Transaction security data: Technical records created when you visit our website, such as IP address, browser information, and date and time of visit.

We do not ask for special categories of personal data (health, religion, ethnic origin, etc.) in the quote form. Please do not enter such information in the comment fields.

3. Purposes of processing

Your personal data are processed for the following purposes:

• Receiving and assessing your quote and information requests and responding to you,
• Identifying the right product and solution for your project, and preparing and sending a price quotation,
• If the quotation is accepted, carrying out contract procedures and planning production, shipping, installation and after-sales services,
• Managing customer relations and following up your requests, suggestions and complaints,
• Ensuring the security and technical operation of our website,
• Fulfilling our legal obligations and responding to requests from competent authorities.

4. Method of collection and legal grounds

Your personal data are collected partly or fully by automated means through the quote form on our website, email, phone, WhatsApp and face-to-face meetings. Technical records relating to website visits are created automatically through cookies and server logs.

These data are processed on the following legal grounds set out in Article 5(2) of the KVKK:

• (c) Processing is directly related to the conclusion or performance of a contract: Assessing your quote request, preparing the quotation and carrying out contract procedures.
• (ç) Processing is necessary for the data controller to comply with a legal obligation: Record-keeping and retention obligations arising from tax, commercial and other legislation.
• (f) Processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject: Following up requests, managing customer relations and website security.

Your personal data are not used to send you commercial electronic messages (advertising, campaigns, etc.). If we ever send such messages, your consent will be obtained separately in accordance with the applicable legislation.

5. Transfer of personal data

Your personal data may be transferred to the following parties, limited to the purposes above and in accordance with Articles 8 and 9 of the KVKK:

• Our service providers: Business partners from whom we receive website hosting, email, IT and accounting services,
• Our shipping and installation partners: If the quotation is accepted, transport and crane service providers, to the extent necessary for delivery and installation,
• Competent public authorities and institutions: Within the scope of our legal obligations and upon request.

The servers of some technical services used on our website, such as maps and messaging, may be located outside Türkiye. Where a transfer abroad is required, it is carried out in accordance with the conditions set out in Article 9 of the KVKK.

6. Retention period

Your personal data are retained for as long as required by the purpose of processing and for the retention periods set out in the applicable legislation. Requests that do not result in a quotation are kept for a maximum of 2 years from the date of last contact. Records of transactions that become contracts are kept for the periods required by tax and commercial legislation. Data whose retention period has expired are deleted, destroyed or anonymised.

7. Your rights under the KVKK

Under Article 11 of the KVKK, by applying to our Company you have the right to:

• Learn whether your personal data are being processed,
• Request information if they have been processed,
• Learn the purpose of processing and whether they are used in accordance with that purpose,
• Know the third parties in Türkiye or abroad to whom they have been transferred,
• Request correction if they have been processed incompletely or inaccurately,
• Request their deletion or destruction under the conditions set out in Article 7 of the KVKK,
• Request that the correction, deletion or destruction be notified to the third parties to whom the data have been transferred,
• Object to a result to your detriment arising from the analysis of the processed data exclusively through automated systems,
• Claim compensation if you suffer damage due to unlawful processing.

8. How to apply

In accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, you can submit requests regarding your rights, clearly stating your identifying information and your request:

• In person or through a notary, with a signed letter to our address above,
• Signed with a secure electronic signature or mobile signature,
• From the email address you have previously notified to us and that is registered in our system

Your applications will be concluded free of charge as soon as possible and within 30 days at the latest, depending on the nature of the request. If the process requires an additional cost, the fee set by the Turkish Personal Data Protection Board may be charged.

9. Cookies

Our website uses strictly necessary cookies for its proper operation and security. You can delete or block cookies in your browser settings; however, some parts of the website may then not work as expected.

10. Changes

This privacy notice may be updated in line with changes in legislation and in our data processing activities. The current version is always published on this page.
